Terms and Conditions
The following Terms and Conditions apply:
Renters are asked to read carefully and confirm acceptance by signing this Rental Agreement. Renters must fulfil all requirements of this agreement.THE OWNER HAS THE RIGHT NOT TO RENT A VEHICLE TO ANY RENTER WITHOUT SUPPLEMENTARY EXPLANATION
Driver's age: minimum 24 years.
Driver must be in possession of a valid driving license which has been in force for at least one calendar year.
THE RENTER SHALL BE FINANCIALLY RESPONSIBLE TO THE OWNER FOR ANY ACCIDENT OR DAMAGE TO THE VEHICLE CAUSED BY A DRIVER NOT EXPLICITLY AUTHORISED BY THE OWNER
The vehicle is delivered to the renter in good condition, with no visible defect. Any complaint regarding the condition of the vehicle must be made at the time of delivery. The renter agrees to return the vehicle in good condition together with all the vehicle's documents, accessories and equipment at the place, date and time recorded in this agreement. Any delay will be reported to the police as theft of the vehicle
and the deposit will be retained.
CONDITIONS OF USE
The renter agrees to the following conditions of use. The vehicle must not be:
a) used in contravention of prevailing traffic regulations or any provision of the law;
b) used for the transportation for hire or reward of either passengers or goods;
c) used in contravention of restrictions on weight or the number of passengers as recorded in the vehicle's registration document;
d) used to push or tow another vehicle or trailer of whatever description;
e) driven whilst the driver is under the influence of alcohol, drugs, narcotics, barbiturates, or any other substance which could affect the driver's concentration, mental state or driving capability;
f) repaired except at a service establishment explicitly authorised by the owner;
g) used for competition, performance testing or racing;
h) left unlocked, with the key in the ignition, or with open doors, windows or boot;
i) used except according to the vehicle manufacturer's instructions and recommendations.
ACTING IN CONTRAVENTION OF THESE CONDITIONS OF USE WILL PLACE THE RENTER AT ABSOLUTE FINANCIAL RISK IN FAVOUR OF THE OWNER
The renter is personally responsible for paying the rental fee to the owner as specified below:
The time fee will be as specified in this Rental Agreement.
b) The vehicle will be delivered to the renter with a full tank - the fuel gauge will be used to estimate the quantity of fuel required to fill the tank after return of the vehicle and this will be charged at the normal retail price of fuel.
c) The minimum rental duration is 24 hours. The first hour thereafter will be a no cost grace period. Beyond one hour, an additional day's rental at the standard rate will be payable.
d) The renter will be responsible for traffic fines or any cost arising from infringement of the law.
e) In the event of loss of documents. Rental Agreement or car keys, a flat charge
of € 200 will be payable.
f) A deposit
from € 300 is required. This will be refunded to the renter at the time of return of the vehicle provided that the vehicle is returned in good condition, with the vehicle's documents, accessories and equipment at the place, date and time written in this agreement.
IF THE VEHICLE IS SCRATCHED, OR HAS SUFFERED DAMAGE TO THE UPHOLSTERY OR WHATEVER NATURE, OR OTHER SIGNIFICANT DAMAGE AS DETERMINED BY THE OWNER, THE DEPOSIT WILL NOT BE RETURNED.
The owner has full comprehensive cover for the rented vehicle. Personal accident insurance for the renter and other occupants of the vehicle are
not included in the price of the rental. The renter is responsible for, and agrees to pay for all expense, damage and depreciation in value caused by:
a) incorrect or unapproved maintenance of the vehicle, including damage to the engine, transmission or differential arising from inadequate lubrication or overheating;
b) damage to the tires and inner tubes caused by underinflation, cuts, impact with the kerb or blow-outs;
c) damage to the vehicle's electrical system of whatever nature;
d) damage arising from driving on flooded roads;
e) damage to the vehicle or its sub-systems arising from lack of observance of construction and use regulations, including overloading of the vehicle;
f) damage to the spare wheel or tire, to interior trim, or to any tools or other equipment supplied with the Vehicle;
g) damage resulting from racing, competition or driver training;
h) damage which:
- is wilfully caused;
- results from use by the driver whilst under the influence of alcohol, drugs, narcotics, barbiturates, or any other substance which could affect the driver's concentration, mental state or driving capability;
- results from action which would be in contravention of traffic regulations, even if not occurring on a public road;
- occurs in conjunction with another criminal or illegal act by the driver or renter;
- arises while the driver or renter is seeking to avoid arrest or fails to stop when requested to do so by any lawful authority;
any theft or attempted theft which is not confirmed by the Police or which is not reported to the Police or which is the responsibility of any person or persons connected to the renter.
The owner shall not be responsible for financial loss caused by any defect or malfunction caused directly or indirectly by the renter, or by persons connected to the renter, nor for the loss of objects inside the vehicle, nor any other cause.
ACTION IN CASE OF ACCIDENT, THEFT OR DAMAGE
The renter agrees to protect the owner and his insurance company's interests in the case of accident, theft or damage by:IF THE RENTER DOES NOT OBTAIN THE ABOVE REFERENCED DOCUMENTS, OR IF THE RENTER IS RESPONSIBLE FOR ANY INFRINGEMENT OF ROMANIAN LAW, INCLUDING TRAFFIC LAW, OR IF THE RENTER OR CONNECTED PERSON(S) ACT(S) IN CONTRAVENTION OF THE TERMS OF THIS RENTAL AGREEMENT, THE RENTER SHALL BE WHOLLY RESPONSIBLE FOR THE ASSOCIATED COSTS OR LOSSES ARISING.
a) obtaining the names and addresses of witnesses or third parties;
b) ensuring that the vehicle is not left unsupervised;
c) informing the owner by telephone

The following documents must be obtained from the nearest Police Station immediately after the accident or theft:
a) Police report or second annexe signed by the Officer who wrote the report and stamped by the Police Station;
b) In the case of accident, a Police affidavit that the driver was not driving under the influence of alcohol;
c) Authorisation for repair of the vehicle signed by the Officer who wrote the report and stamped by the Police Station.
CHANGES IN TERMS OF THIS AGREEMENT
The renter agrees that no change in the terms and conditions of this agreement shall be recognized unless they have the prior written agreement of both parties.
Any dispute that may arise from the terms and conditions of this Rental Agreement shall be subject to adjudication at the Court of Bucharest in Romania.
